There have been a number of amendments within the United States Constitution that have distinguished themselves as having an important and lasting quality, more so than other amendments. The first amendment with its protection of religious freedom, freedom of the press, assembly, speech and petition is seen as the most important. The 2nd amendment which states that a well organized militia is allowed to carry arms and which the Supreme Court has interpreted it to mean all law abiding citizens have the right to carry arms has been a source of debate for many years. The 14th Amendment, which established citizenship for all persons born within the United States had enormous historical and political implications as it overturns the Dred Scott Supreme Court Decision of 1857, strengthens the 13th Amendment and helps pave the way for the 15th Amendment as well as the Civil Rights Act of 1875. The second important yet forgotten amendment within the Constitution is the 19th Amendment which gives woman the right to vote. This amendment as well has large historical and political implications as well since the current frontrunner in the quest for the Democratic nomination for President is Hillary Clinton: a woman. This modern turn of events would not have been made possible if not only for the 19th amendment but also the decades of protests and all the work on behalf of women’s suffrage that took place. The 14th Amendment states that no state can infringe upon the rights of any person, regardless of their race: â€Å"Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws. † This is a key aspect of the text as it helps to strengthen the 13th amendment as well. With the passage of the 13th amendment on January 1, 1863, nothing really changed. The Southern States, who were in rebellion against the Union, felt that they were no longer bound to obey any laws that came out of Washington. The amendment would have to be recognized once the Union won the Civil War and brought the southern states back into the Union. To a lesser degree, the same could be said about the 14th amendment and its relation to its predecessor, the 13th amendment. After the war, there was no longer any slavery and four million African Americans were left at the doorstep of the Federal government while still residing in the Southern states. The great migration of African Americans to the Northern cities was still decades in the future. So as a result, southern legislatures sought to put African Americans back in a type of quasi slavery though oppressive Jim Crow and black code laws. These laws were designed to return blacks to their pre war condition of submission to the white establishment. This was accomplished through restrictive measures that prevented African Americans from suing in court, testifying in court, being a member of a jury as well as being able to own a gun. African Americans were not allowed to gather on a street corner by themselves and racial discrimination regarding public places was understood to be included in these black codes as well. The 14th amendment was passed during Reconstruction. Abraham Lincoln had been assassinated and Vice President Johnson, a southerner from Tennessee had been made president. He was from the south but loathed the south’s actions of rebellion during the civil war. However, those feelings seem to pass as he vetoed nearly every civil rights bill that was passed by Congress during his years in office. It would be these actions by President Johnson that would give him the dubious honor of being the first President to be impeached. He avoided banishment by one vote in the senate but the success of his presidency was over. It is in this context that the 14th amendment was passed since in the end, the 14th amendment is a civil rights bill that would be challenged in the years after its passage. The 14th Amendment did not go as far as the Radical Republicans, as they were called, wanted it to go. The 15th amendment and the 1875 Civil Rights Act, built upon the power that the 13th and 14th amendments went in securing the rights of individuals under the Constitution, regardless of their race. The power of the 14th Amendment would be limited after the Supreme Court outlawed the 1875 Civil Rights Act which was built upon the power of the 14th amendment. The Supreme Court said that only the state was prohibited from infringing upon the Civil Rights of an individual and that private businesses could be allowed to implement such practices as segregation or refusal to rent or sell to an African American if they chose to do so. The power of the 14th Amendment would be further decreased with the 1890 Supreme Court Case Plessey vs. Ferguson. The Supreme Court held that the states could not impose segregation on public places as long as those facilities were â€Å"separate but equal. † There were many at the time of the passage of the 14th amendment and who felt that they were responsible for it passage, who regarded the 14th amendment as having broad powers concerning its ability to give African Americans equal protection and recognition under the law. In the immediate years after the passage of the amendment, this seemed to be more and more, less likely to occur. The original intent of the law and its power would not be seen until the 20th century with such decisions as Brown vs. Board or Education (1954) which stuck down forever, racial discrimination within public places. Another important aspect of the 14 amendment was the fact that since African Americans was now seen as citizens, their representation in Congress needed to be known. The section reads: Section 2. â€Å"Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed. But when the right to vote at any election for the choice of electors for President and Vice-President of the United States, Representatives in Congress, the Executive and Judicial officers of a State, or the members of the Legislature thereof, is denied to any of the male inhabitants of such State, being twenty-one years of age, and citizens of the United States, or in any way abridged, except for participation in rebellion, or other crime, the basis of representation therein shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens twenty-one years of age in such State. † Although not at the immediate time of its passage, this section allows for African Americans, now citizens, to be represented in Congress. This struck down the previous â€Å"three-fifths† clause which states that for political reasons, African Americans would be counted as only 3/5 of a vote and therefore, not seen by the government as a complete person. The 14th amendment, continuing on the theme of Civil Rights, struck down this offensive aspect of the Original Constitution in order to give African Americas, now citizens, the rights afforded to them as citizens of The United States of America. Full rights for African Americans would not be realized for many more decades but the 14th amendment did a great deal in increasing those rights that help each citizen to feel as though they are a part of the democratic process and are recognized in such a capacity. The struggle for women’s suffrage reached its peak during the late 1800s. But the famous 1848 meeting at Seneca Falls New York, directed by Elizabeth Caty Stanton and Lucretia Mott, two giants in the cause for women’s suffrage fought long and hard for the right to be able to vote. The first state to allow women to vote was Wyoming in 1870 and women were even allowed to sit as jurors but there was no federal amendment to protect a woman’s right to vote and the majority of the country did not recognize a woman’s right to vote. The cause for women’s suffrage would enjoy a resurgence during the abolitionist days and the move against slavery. The fight for equal rights for African Americans could not help but remind the female abolitionists that they did not even have some of the rights that the former slaves were bound to receive once their freedom would be won. This came to fruition with help from the 14th Amendment. This amendment not only gave citizenship to all individuals that were born in the United States, meaning four million former slaves would now be considered citizens but also gave voting rights to all males in the country. In May 1869, the National Woman Suffrage Association was founded by Elizabeth Caty Stanton and Susan B. Anthony. The organization set out to win a national amendment which would grant women the right to vote. In November 1869, the American Woman Suffrage Association was formed and fought for both state and federal woman suffrage amendments. This helped lay the groundwork for the national campaigns in Washington D. C. in 1912. In 1917, the Susan B. Anthony Federal Suffrage amendment was placed before the House. In 1919, both houses of Congress approved the amendment and it went to the state legislatures for ratification. The approval of thirty six states were needed before the suffrage amendment could become law and surprisingly, the states moved with surprising speed and in August 1920, the 19th Amendment became part of the Constitution. The wording of the amendment reads as such: The right of citizens in the United States to vote shall not be denied or abridged by the United States or by any State on account of sex. Congress shall have power to enforce this article by appropriate legislation. Both the 14th and 19th Amendments expand the rights of an important segment of the population. Such amendments have been forgotten because the rights that they protect are seen as never having a starting point for a large segment of the population that seems oblivious to anything that has happened before they were born. Recently, a popular comedy television show, had as one of its comedy pieces, set up a table outside of a busy walkway and sought out women to sign a petition: â€Å"To end Women’s Suffrage. † An alarming number of women as well as men signed the petition, possibly confusing suffrage for suffering. It is due to this amazing level of ignorance that the history, wording and influence of these above mentioned amendments be reintroduced into the nation’s consciousness. The 19th amendment gave women the right to vote but it also told women what they already knew: that they were an important aspect of the American democratic system and that their involvement was required. Women then became governors, senators, representatives, Supreme Court judges and in 2008, possibly the next President of the United States. The 19th Amendment helped make all of this come to fruition, along with the dedication and perseverance of a lot of women and men as well. The 14th amendment is also one of those amendments whose forgotten memory serves as an impediment to every American who assumes that they ways that things are today, is how they have always been. In this manner, history’s importance is all too often underestimated as ignorance breeds apathy for the works and sacrifice of others who came before. When Americans think of civil rights, they think of Martin Luther King Jr. Rosa Parks and perhaps even Jesse Jackson. But the study of civil rights must first start in the 18th and 19th century if at all. â€Å"The 13th, 14th and 15th amendments which greatly increased the rights for all peoples, regardless of their race as well as the 19th amendment, all had their origins in the 19th century. † And as it is with most amendments, its origins are seen years and decades before its actual passage and many times, opens the door for further legislation in the future. Life can be compared to one big Christmas present. Wrapped all neatly under the tree, the lights dancing off the paper, the possibilities of what’s inside are endless. It could be that new baseball bat you wanted or the Barbie Dream House you’ve been staring at in the Toys R Us magazine for months. You go over and examine the shape more closely and realize it’s too big to be a bat. You shake it and it’s heavy, really heavy, but you don’t hear the rattle of little pieces bouncing around so that makes you doubt it’s the Dream House. Your curiosity is killing you and you beg and beg your parents for just one little hint of what it is. You just want to know the first letter of it, or the store it was bought from, something, anything to aid you in discovering what it is. They won’t budge one bit, so one day when they’re upstairs you slide your finger under the tape at the seam hoping to get a glimpse. Your mom has double wrapped it knowing you’d try and peak. In a moment of desperation you decide to rip the smallest corner of the paper instead. It’s a manila cardboard box. You rip just the slightest bit more and see the letter â€Å"M†. You quickly place the present back under the tree and make sure the rip is hidden from view. What on earth did you ask for that began with an â€Å"M†? Your mind goes blank and you have no idea. Organization Behavior and Leadership Essay The Expectancy Theory of Motivation One of the most widely accepted theories of motivation is Victor Vrooms Expectancy Theory. â€Å"Expectancy theory argues that the strength of a tendency to act in a certain way depends on the strength of an expectation that the act will be followed by a given outcome and on the attractiveness of that outcome to the individual.† (Robbins Judge, 2007, p.208) [i] In other words, employees will have the motivation to put forth a strong effort, if: They believe the effort will give them positive recognition. (This is called the â€Å"effort-performance† relationship.) That positive recognition must then lead to some kind of desirable reward, such as more money or an increase in status or power. (This is called the â€Å"performance-reward† relationship.) That reward must also be something that fulfills a personal goal for the employee. (This is called the â€Å"rewards-personal goals† relationship.) All three components need to be present for an individual to exert the kind of effort needed to be considered an intense motivation for action and performance of a duty or task. They are the first and earliest teachers for the children. I myself as a parent must admit that my son behaves best when I attend to him the most. Though he’s just three years old yet I find that his behaviour is far better when I spend quality and quantity time with him. Parents have the capability of influencing and leading the child from the first day they are born until the age of 18 by being a role model. In other words, parents are the best teachers. Parents teach how to speak, how to behave, the basic etiquettes etc. thus help the child to grow into a morally responsible and sound individual. All the complications, challenges, barriers, obstacles a child encounters in her or his childhood can be overcome if it is correctly approached through their parents. No matter how hard the professional teachers in school strive, to rectify or mould the child, the child’s best place for correction is at home i. e. with the parents. In spite of the fact that teachers play a vital role in child’s life, it is equally important to note that parental leadership supersedes all. The nature’s bond, love and understanding between the child and the parent are so strong that the child can relate to the parents more effectively and they can lead the child to the correct path whenever he or she is wrong. This is equally applicable in academics as well. A child with a parental support and teaching performs far better than a child without it. A child is easily motivated in class when the parents are regularly checking their books and attending to academics. On the other hand, a child without support even if intelligent might not perform so well. Nevertheless, not all parents are best teachers. A parent controlling the child by beating him or her up or using some other negative reinforcement will certainly make the child lose the trust in parents thus weaken the parent-child bond. Similarly, parents with some bad habits will definitely harm the child if they do not give a right role model image to the child. So, it is extremely important that parents must learn to be role model for the child thus leading them by good examples. The objective of this paper is to bring to light a field in social work not widely publicized or acknowledged by a large majority of universities offering social work programs. Brownell and Roberts (2002) operationally define forensic social work as ‘policies, practices and social work roles with juvenile and adult offenders and victims of crimes’ (Brownell P & Roberts AR 2002, A century of social work in criminal justice and correctional settings, Journal of Offender rehabilitation, 35 (2) 1-17, pg. 3) As times progressed a growing knowledge and understanding of mental illness and psychiatric problems became more of a deciding factor in the task of determining just and effective dispositions. The criminal justice system is not equipped to provide the proper type of facilitation needed to accommodate. Instead judges and lawyers reached out to community mental health agencies but they too were unable to adequately provide resources needed. According to Gary Whitmer (1983) resulting from this dilemma the courts adjudicate with a sense of futility, knowing that it is not the defendant’s reasoned criminal intent but an illness that had brought him or her to court and that, if left untreated, this illness will bring the defendant back to court sooner then later. The Office of the Appellate Defender (OAD) is a not-for-profit organization that has been providing high quality appellate and post-conviction representation to indigent persons since 1988. The office of the Appellate Defenders fills an important need in the criminal justice system and advocacy for the destitute. OAD is the second longest-standing institutional indigent defense office and oldest provider of appellate representation to indigent persons convicted of felonies. (www. ppellatedefender. org ) Attorneys participate in the Office of Appellate Defender's comprehensive training program, which focuses on appellate advocacy, client relations, procedural and substantive criminal law. The up and coming collaboration between the fields of Public defense and forensic social work is monumental in the need for holistic trial representation. But the need for holistic representation does not end at sentencing. According to The National Association of Criminal Defense Lawyers describes the †catch basin for the reakdown of social services inside communities† depicting the defense function within the criminal justice system given by the National Association of Criminal Defense Lawyers. The assistance that social workers can provide is an appellate office takes on the role of assisting with the legal representation thorough investigation, mitigation and counseling. Social workers also provide institutional advocacy on behalf of clients. Another important function provided is that of case management, support and necessary referrals for clients preparing for release. During the assessment stage of the case management process the interview leads into the documentation of individual history. Each individual walking this earth has a unique story to tell. And these stories paint the picture that portrays where we are in our lives at any given point in time. The job of a multidisciplinary mitigation team is to link client’s history, life circumstances, and the commission of the crime accurately and clearly. Often complex, it reveals that the client’s behavior stems from a number of integrating factors. In their article, â€Å"From Misery to Mission: Forensic Social Work on Multidisciplinary Mitigation Teams,† Guin, Noble and Merrill(2003) provide mitigating factors and circumstances inking characteristics and history to criminal behavior in the representation on behalf of defendants in capital cases (Guin, Noble, and Merrill/ From Misery to Mission: Forensic Social Works on Multidisciplinary Mitigation teams) â€Å"The capital mitigation process comes to life when a social worker, using a life history model of investigation, assumes the role of mitigation specialist, who, by capitalizing on social work theory and research, practice knowledge and skills yields vital information that, through objective presentation of fact, guides sentencing decisions. (p. 424) Social Workers are given the task of one of the most important components of building an understanding of the individual you’re advocating for and conceptualizing a rundown of an individual’s life history. Documenting of a defendant’s life history a forensic social worker is gaining insight on possible links to the development of criminal behavior. The intake is a way of establishing a rapport and may involve crisis intervention. The interview is almost always performed face to face and may be videotaped for later use in a court of law. Next is the assessment phase. This phase involves interviews, substance abuse evaluations, and specialized psychological evaluations. Some of the bases covered include family medical history for any red flags involving mental illness, significant incidents of past trauma, this may include both physical abuse, sexual abuse or neglect. Others may come from a financial comfortable family with a dog and a white picket fence. According to The National Organization of Forensic Social Work (NOFSW), the forensic social work practitioner provides: consultation, education & training, diagnosis, treatment and recommendations in various agencies. In addition, the NOFSW also points out that within the field of forensic social work, a clinician may undertake policy, program development, mediation, advocacy, and arbitration. Green; Thrope; Traupmann; the Sprawling Thicket Australian Social Work/June 2005) Barker and Branson (2000) summarize the Field of Forensic Social Work narrowing it down to 10 core areas. Some of these areas: 1. testifying in courts of law as expert witness. 2. Systematically evaluating individuals so that the resulting information can be used in court or by legal authorities. 3. Investigating cases where criminal conduct may have occurred and presenting the results to judges, juries, and other law authorities. . Recommending to the courts of law ways to resolve, punish or rehabilitate those found guilty of criminal acts or negligence in civil actions. Also included in the 10 core areas of Barker and Branson’s Legal aspects of Professional Practice in the forensic social work field are to; facilitate the court ordered sentence of the convicted person, monitoring and reporting progress to the courts. 6. Mediate between individuals and groups involved in disputed and conflicts. 7.  Testify about professional standards of social work to facilitate cases of possible malpractice or unethical conduct. 8. Facilitate development and enforcement of licensing laws to r egulate professional practice. 10. Maintain relationships with their own clients that uphold the letter and spirit of the law and ethical principals of their profession. (Barker & Branson Legal aspects of Professional Practice, 2000) Mark Cameron and Elizabeth Keenan created a practice model that is adapted from the structures offered by Grenscavage and Norcross known as The Common Factors Model.  Cameron and Keenan provide three addition new and potentially useful conceptualizations. First, is the conceptualization developed on the basis of ways in which factors function in practice as condition and process that are activated and; Facilitated by strategies and skills for change? Second is the System of Action. Suggesting that conditions and processes interact as a â€Å"system of action†; factors reciprocally influence each other, inevitably producing change. The third conceptualization is based on Locus of practice competencies. Finally common factors are convinced as pertaining not only to the social worker and the client, but all those involved in the change work, including family, informal social supporters, and helpers in social services, education, health care organizations, and the judicial system. † (Cameron & Keenan; The Common Factors Model; p. 65) Roberts and Brownell (1995) define Forensic Social work as â€Å"the practice specialty in social work that focuses on Law and educating law professional about social welfare issues and social workers about the legal aspects of their objectives† as defined by Barker,(p. 60). They go on to pen a section entitled Professional Recognition of forensic social work as a Field of Practice. This is an important part of why I chose to do my capstone paper on Forensic Social work in the first place. I’ve came to realize what little attention is given to this particular field of social work practice in general. Roberts and Brownell (1995) discuss the need for social workers them selves to recognize that a specialization in forensics has developed in recent years not just in social work but among other professional groups such as psychology, psychiatry and nursing. A Century of Forensic Social Work: Bridging the Past to the Present, 1999) The fact that there should be a distinct and prominent role for forensic social workers; the need to recognize that this area of practice; if we were to consider social work in corrections and probation, forensic mental health, substance abuse, family/criminal court, domestic violence and child abuse and neglect, it is a natural outgrowth of the leadership exerted by Jane Adams, Julia Lathrop and other prominent forensic social work ers in the late 1800’s.
